Proposed Federal Spam Legislation Simplifies Rules

We've heard from many email marketers concerned about California's new anti-spam legislation, which called for strict opt-in policies for commercial email, and harsh penaties for violators.

However, this week the California law was pre-empted by federal legislation (known as the "CAN-SPAM" Act of 2003). The federal law does not require an opt-in or direct business relationship; instead, it requires mailers to follow more basic rules such as providing an opt-out mechanism and labelling any adult content.

We expect most Lyris software and hosting clients will have no trouble complying with these requirements. We do recommend that you read our CAN-SPAM FAQs and advice.
